Commercial Warranties

Effective from November 1, 2024

As the manufacturer, BURGER & CIE (hereinafter referred to as “the Manufacturer”) guarantees its products sold under the “GRAD” brand as follows:

Only the products listed below are covered by a commercial warranty offered by BURGER & CIE or one of its raw material suppliers, whose terms of application are outlined in the general conditions specified below.

BURGER & CIE reminds that:

  • The design by BURGER & CIE of installation plans/schemes for “GRAD” branded products specific to a project requested by a professional client is provided solely as a technical proposal and does not in any way imply BURGER & CIE’s responsibility as the project manager.

In no case is the manufacture of “GRAD” products (resulting from an order during which a plan was proposed by BURGER) carried out specifically for the project undertaken by the professional client, as these products are manufactured in series.

  • Any installer of “GRAD” branded products purchased from BURGER & CIE remains responsible for implementing its legal warranties or any other commercial warranties it may offer to its clients. As a reseller of “GRAD” branded products, all legal warranties are applicable.

  • As a professional, any installer of “GRAD” products is required to comply with the standard industry practices applicable to each project, failing which their liability may be engaged.

* Legal warranty

All products marketed by BURGER & CIE are covered by the applicable legal warranties, including:

Hidden Defect Warranty

It covers:

  • Any hidden defect as defined by Articles 1641 and following of the French Civil Code, applicable for a period of 2 (two) years starting from the discovery of the defect, provided the claim is made within 5 (five) years following the completion of the sale.

A hidden defect is defined as any flaw in the product that renders it unfit for its intended use or that diminishes its use so much that the buyer would not have purchased it or would have bought it at a lower price had they known about the defect.

This warranty applies when:

  • The defect was hidden,

  • The defect existed at the time of purchase,

  • The defect rendered the product unusable.

Legal Warranty of Conformity

It covers:

  • Any defect related to the conformity of the product, as defined by Articles L. 217-4 and following of the French Consumer Code, which requires every seller to guarantee the conformity of goods sold to consumers, for a period of 2 years starting from the delivery of the product, and exclusively benefits the consumer clientele as defined by the preamble of the Consumer Code.

The conditions of the legal warranties are governed by the provisions set out by the applicable legal and regulatory standards for each warranty.

* Commercial Warranty (additional to the legal warranties)

Commercial in nature, the Manufacturer’s warranty (hereinafter referred to as the “Warranty”) is supplementary and optional. It is the only contractual warranty offered by BURGER & CIE for its “GRAD” branded products.

The Warranty is offered by the Manufacturer to the end user of the products it manufactures under the “GRAD” brand (hereinafter referred to as the “Beneficiary”);
The Manufacturer reserves the right to occasionally modify the terms of this Warranty, with any modifications applying to products purchased after the changes take effect;
The Beneficiary may contact each professional involved in the design and installation of the products covered by the Warranty to activate any commercial warranties they may offer, which the user could potentially benefit from.
The Manufacturer is not bound by the commercial warranties provided by other parties involved in the manufacturing, design, or installation processes of the products delivered to the Beneficiary, including the professional installing the Manufacturer’s products (hereinafter referred to as the “Installer”).
The Manufacturer is only bound by its own Warranty.

Scope of Application of the Warranty

The Warranty covers defects found on the products listed below, provided they meet the general and specific conditions of the Warranty.

The conditions for implementing the Warranty (products covered, duration, warranty holder, conditions, exclusions, etc.) are outlined in the “General Conditions” and “Specific Conditions” for each product’s warranty.

It constitutes a contractual commitment from the Manufacturer to the Beneficiary, as defined by Articles L. 217-15 and following of the French Consumer Code.

* General Terms and Conditions

The Warranty applies only to the Beneficiary if they are able to prove to the Manufacturer that the installation, maintenance, and upkeep instructions provided by the Manufacturer for its products, whether general or specific to each product, have been followed.

As far as possible, the Beneficiary is required to raise any reservations at the time of receiving their project if they believe that the various parties involved in the installation of the ordered product (including the Installer) have not adhered to the storage and maintenance conditions set by the Manufacturer.

The Warranty can only apply if the use of GRAD products aligns with the intended purpose as defined by BURGER & CIE for these products within the GRAD concept, as outlined in the technical data sheets for the products marketed by the company.

In case of doubt, the Beneficiary is asked to verify the suitability of the GRAD products’ intended use with the intended application they are planning.

BURGER & CIE cannot be held responsible for any use of its products that does not correspond to the recommended uses. If this condition is not met, the Warranty cannot apply. It is the responsibility of each Beneficiary to ensure this by consulting the technical data sheets and product information available in the GRAD catalog or on the website https://grad-system.com/.

In the event of the Warranty being activated, the Manufacturer reserves the right to verify whether the storage and maintenance conditions have been adhered to by all individuals involved in storing or maintaining the products and to pursue any claims against the party responsible for failing to meet these obligations.

* General Exclusions

The Warranty does not apply to replacement and wear parts (natural wear of the product – wear caused by lack of maintenance or improper maintenance; wear caused by failure to follow the Manufacturer’s maintenance guide provided).

The Warranty does not apply to products that are not listed in the specific conditions.

Removal and reinstallation costs are in no case covered by the Warranty.

Depending on the nature of the components of “GRAD” branded products, the following damages are expressly excluded from the Warranty:

  • For wood-based products: warping, splits, cracks, resin pockets.

  • For aluminum-based products: whitening of the surface (slight surface oxidation that does not affect the mechanical strength of the rails) of the “GRAD” branded product due to contact with metal products (copper, galvanized steel) or as a result of immersion, installation near the sea (sea spray), or prolonged contact with highly acidic or alkaline products.

  • For steel-based products: light traces of superficial corrosion due to the exposure of the galvanization when installed near the sea (sea spray).

  • For stainless steel-based products: traces of corrosion due to lack of maintenance resulting from failure to follow the maintenance conditions set by the Seller.

  • For plastic-based products: permanent exposure of the products to light for a period exceeding 6 months (during storage), which may cause whitening and material brittleness.

* Duration

The Warranty applies for a period defined below, starting from the date indicated in the Acceptance Report of the project in the case of express acceptance, or, failing that, from the date of issue of the invoice by the installer of the GRAD products, for orders placed from November 1, 2024.

The Warranty ends when this period expires, with the conditions varying depending on the product manufactured by the Manufacturer, including the nature of the use of the products covered by the Warranty.

Territorial Scope of the Warranty: All countries where our GRAD products are installed (including Member States of the European Union, England, Switzerland, etc.).

Only the products listed below are covered by the Warranty under the specific conditions mentioned below.

I. STRUCTURE

BURGER & CIE sells to its customers under the “GRAD” brand, a decking/cladding concept made up of a structure and cladding or decking elements.

With regard to the components of the structure of its concept, BURGER & CIE offers the Beneficiaries the Warranty applicable to the following specific conditions for each “GRAD” branded product listed below.

1. ALUMINIUM RAIL

Warranty Specific Conditions for this Product:

The specific conditions of the Warranty for this product are defined according to the technical recommendations described and proposed by the DTU 51-4.

Warranty Duration
20 years

This Warranty is valid for a period of 20 years, starting from the date indicated in the Project Acceptance Report in the case of express acceptance, or failing that, from the date of issue of the installer’s invoice for the GRAD products, regarding orders placed from November 1, 2024.

The Warranty does not apply to defects that appear or are reported to the Supplier by the Beneficiary after the expiration of the warranty period.

Damage Covered by the Warranty

  • Oxidation presenting structural risks, leading to deep corrosion causing perforations in the rails installed according to industry-standard practices.

Adherence to industry standards by the client, project manager, and all parties involved (including the Installer) in the execution of the commissioned project is a condition for the Warranty’s implementation.

Exclusions
The Warranty does not apply in the following cases:

  • If the conditions dictated by BURGER & CIE are not met, especially those listed in the installation guide provided by BURGER & CIE (according to the applicable version when the Warranty is implemented).

  • When the following exclusion cases contribute to the damage:

    • Contact with seawater (immersion of rails, rails installed near the immediate seaside),

    • Contact with another metal where the galvanic couple is inappropriate (copper, galvanized steel, etc.),

    • Chemical treatment,

    • Color and appearance changes due to natural aging,

    • Installation in an industrial area due to the risk of chemical discharges accelerating corrosion,

    • Whitening of the surface (slight surface oxidation not affecting the mechanical strength of the rails),

    • Rails in prolonged contact with highly acidic or alkaline products.

Storage Conditions for “Aluminium Rail”
Products covered by the Warranty must be stored according to the Manufacturer’s conditions, i.e., under shelter to protect them from weather conditions (wind, rain, snow, hail), from the effects of moon and sun reflection, and from all extreme pollution.

The storage conditions apply to all persons who may store the products covered by the Warranty, regardless of their role in the completion of the project. Any failure by one of these parties may result in liability being attributed to them.

As far as possible, the Beneficiary is encouraged to check the condition of the product before installation and notify the Manufacturer of any reservations.

The Manufacturer reserves the right not to implement the Warranty if it deems that the Beneficiary has not complied with the storage obligations. The burden is on the Beneficiary to prove that the products were stored according to the Manufacturer’s storage conditions.

In the event of Warranty activation, the Manufacturer reserves the right to verify whether the storage conditions have been respected by all parties involved in the storage of the products and to take action against the person responsible for any breach of these obligations.

Warranty Value:

Replacement of the initially delivered merchandise:
The Manufacturer provides the Beneficiary with an equivalent quantity of merchandise equal to the purchase value, reduced by an obsolescence rate based on the length of time the damaged merchandise has been used*:

  • In the case of private use:

    • 0 – 2 complete years: 100% of the purchase value

    • 3 – 10 complete years: 75% of the purchase value

    • 11 – 15 complete years: 25% of the purchase value

    • 16 – 20 complete years: 10% of the purchase value.

  • In the case of public use:

    • 0 – 2 complete years: 100% of the purchase value

    • 3 – 10 complete years: 50% of the purchase value

    • 11 – 15 complete years: 10% of the purchase value

    • 16 – 20 complete years: 5% of the purchase value.

* The duration of use begins from the express acceptance of the completed work (i.e., the date mentioned in the report of acceptance without reservation), or failing that, from the date of issue of the Installer’s invoice.

2. CLIPS

The specific conditions of the Warranty for this product are defined according to the technical recommendations described and proposed by the DTU 51-4.

Warranty Duration
20 years

This Warranty is valid for a period of 20 years starting from the date indicated in the report of the express acceptance of the work, or failing that, from the date of issue of the Installer’s invoice.

It does not apply to defects that appear or are reported to the Supplier by the Beneficiary after the expiration of the warranty period.

Covered Damage by the Warranty

  • Abnormal deformation or breakage of the clip following installation and use in compliance with the conditions recommended by industry standards.

Compliance with industry standards by the project owner, project manager, and various stakeholders involved in the execution of the ordered work is a condition for the application of the Warranty.

Conditions
The use of wood species, profiles, and structures must be validated by BURGER & CIE for the Warranty to be applicable.

  • Operating temperature range: between -20°C and +60°C.

Exclusions
The Warranty does not apply:

  • If the conditions dictated by BURGER & CIE are not followed, including those in the installation guide provided by BURGER & CIE (according to the version applicable at the time the Warranty is implemented).

  • In case of direct or indirect exposure to UV rays for more than 6 months (during product storage), which may cause whitening and fragility of the material.

Storage Conditions
The products covered by the Warranty must be stored according to the conditions dictated by the Manufacturer, i.e., under shelter to protect them from weather conditions (wind, rain, snow, hail), moon and sun reflections, and all extreme pollutants.

The storage conditions apply to all individuals who may store the products covered by the Warranty, regardless of their role in the project. Any failure by any person may result in them being held responsible.

Where possible, the Beneficiary is encouraged to check the condition of the product before installation and notify the Manufacturer of any reservations.

The Manufacturer reserves the right not to implement the Warranty if it believes that the Beneficiary has not complied with the storage obligations imposed on them. It is the Beneficiary’s responsibility to prove that the products covered by the Warranty have been stored according to the conditions set by the Manufacturer.

In case of activating the Warranty, the Manufacturer reserves the right to verify if the storage conditions have been respected by all parties involved in storing the products and to take action against any party responsible for failing to meet these obligations.

Warranty Value
Replacement of the initially delivered goods:
The Manufacturer will provide the Beneficiary with an equivalent volume of goods, at the purchase value, reduced by the application of an aging rate based on the duration of use of the damaged goods:

For private use:

  • 0 – 2 full years: 100% of the purchase value

  • 3 – 10 full years: 75% of the purchase value

  • 11 – 15 full years: 25% of the purchase value

  • 16 – 20 full years: 10% of the purchase value

For public use:

  • 0 – 2 full years: 100% of the purchase value

  • 3 – 10 full years: 50% of the purchase value

  • 11 – 15 full years: 10% of the purchase value

  • 16 – 20 full years: 5% of the purchase value

  • The duration of use begins from the express acceptance of the ordered work without reservation (i.e., the date mentioned in the report of the acceptance without reservation), or failing that, from the date of the Installer’s invoice.

3.TOP LIFT PRODUCT LINE

 

Warranty Duration:

  • 20 years

  • The warranty period starts from the date mentioned on the receipt of the work (i.e., the “Procès-Verbal” of acceptance). If this is not available, it starts from the date of the installer’s invoice.

Covered by:

Covered Damage under Warranty:

  • Breakage of the plot due to installation and use in accordance with the prescribed guidelines and industry standards.

Conditions for Warranty Activation:

  • Operating temperature range: Between -20°C and +60°C.

  • Stable support: No risk of sinking or deformation of the support.

  • Use of Top+ (reinforcement) for riser heights starting from 3.

Exclusions:
The warranty does not apply if:

  • Conditions set by BURGER & CIE (including installation and maintenance guides) are not followed.

  • The product is exposed to UV rays for more than 6 months during storage, leading to whitening or fragility.

Storage Conditions:

  • Products must be stored according to the manufacturer’s specifications, i.e., under shelter that protects them from bad weather (wind, rain, snow, hail), the effects of moonlight and sunlight, and all extreme pollution.

  • Storage conditions must be followed by anyone handling the product. Any violation could lead to liability.

  • The Beneficiary must inspect the products before installation and notify the manufacturer of any issues.

  • If the manufacturer finds that storage conditions were not respected, they may refuse to honor the warranty.

Warranty Coverage Value:

  • Replacement of the originally delivered goods:

    • The manufacturer will provide goods equivalent to the original, but with a depreciation rate based on the usage period of the damaged goods.

Depreciation for Private Use:

  • 0 – 2 years: 100% of the purchase price

  • 3 – 10 years: 75% of the purchase price

  • 11 – 15 years: 50% of the purchase price

  • 16 – 20 years: 10% of the purchase price

Depreciation for Public Use:

  • 0 – 2 years: 100% of the purchase price

  • 3 – 10 years: 50% of the purchase price

  • 11 – 15 years: 10% of the purchase price

  • 16 – 20 years: 5% of the purchase price

4.TOP SCREW / TOP RAIL

he Specific Warranty Conditions for this Product are Defined According to the Technical Recommendations Described and Proposed by DTU 51-4.

Warranty Duration:

  • 20 years

  • This warranty is valid for a period of 20 years, starting from the date mentioned in the Acceptance Report of the work in case of express reception. If unavailable, the warranty period begins from the date of issuance of the Installer’s invoice.

Warranty Provider:

Covered Damages:

  • Breakage of the pad occurring as a result of installation and use in compliance with the prescribed technical conditions and practices according to the rules of the trade.

The implementation of this warranty is subject to the proper execution of the project by the project owner, project manager, and the various stakeholders (including the installer) involved in the completion of the project.

Conditions:

  • Operating temperature range: between -20°C and +60°C

  • Hard support (concrete or tiling)

  • Private use only (solicitation level 1 according to DTU 51.4)

Exclusions:
The warranty does not apply in the following cases:

  • Violation of conditions set by BURGER & CIE, including those in the installation and maintenance guide provided by BURGER & CIE (according to the version applicable at the time of warranty implementation).

  • Exposure to UV rays, either directly or indirectly, for more than 6 months (during storage), which may cause whitening and fragility of the material.

  • Installation and use of the product on a terrace with a waterproofing system.

Storage Conditions:

  • The products covered by the warranty must be stored in accordance with the manufacturer’s instructions, i.e., under shelter to protect from the weather (wind, rain, snow, hail), from the effects of moonlight and sunlight, and from all extreme pollution.

These storage conditions apply to anyone responsible for storing the products, regardless of their role in the project. Any failure to comply may result in the person being held responsible.

To the extent possible, the Beneficiary is encouraged to check the condition of the product before installation and notify the manufacturer of any reservations regarding the product.

The manufacturer reserves the right to refuse the warranty if they deem the Beneficiary has not adhered to the required storage conditions. The Beneficiary is responsible for proving that the products were stored according to the manufacturer’s storage guidelines.

In case of warranty activation, the manufacturer reserves the right to verify if the storage conditions have been respected by all parties involved and may take action against the person responsible for the failure to comply with these obligations.

Warranty Value:

  • Replacement of the originally delivered goods:
    The manufacturer will provide the Beneficiary with goods equivalent in volume and value to the original purchase, reduced by the application of a depreciation rate based on the duration of use of the damaged product.

Private Use Depreciation:

  • 0 – 2 full years: 100% of the purchase value

  • 3 – 10 full years: 75% of the purchase value

  • 11 – 15 full years: 50% of the purchase value

  • 16 – 20 full years: 10% of the purchase value

Public Use Depreciation:

  • 0 – 2 full years: 100% of the purchase value

  • 3 – 10 full years: 50% of the purchase value

  • 11 – 15 full years: 10% of the purchase value

  • 16 – 20 full years: 5% of the purchase value

Note: The duration of use begins from the express acceptance without reservation of the ordered work (i.e., the date mentioned in the acceptance report), or, if this is unavailable, from the date of issuance of the installer’s invoice.

5.TOP CUBE

The Specific Warranty Conditions for this Product are Defined According to the Technical Recommendations Described and Proposed by DTU 51-4.

Warranty Duration:

  • 20 years

  • This warranty is valid for a period of 20 years, starting from the date indicated in the Acceptance Report of the work in case of express reception, or, if unavailable, from the date of issuance of the Installer’s invoice.

Warranty Provider:

Covered Damages:

  • Breakage of the cube occurring as a result of installation and use in compliance with the prescribed conditions and practices according to the rules of the trade.

The implementation of this warranty depends on the adherence to the rules of the trade by the project owner, project manager, and all involved parties in the completion of the project.

Conditions:

  • Operating temperature range: between -20°C and +60°C

  • Assembled on an aluminum profile of the “Grad” brand

  • Hard support (concrete or tiling) or stable surface

Exclusions:
The warranty does not apply in the following cases:

  • Violation of the conditions set by BURGER & CIE, including those in the installation and maintenance guide provided by BURGER & CIE (according to the version applicable at the time of warranty implementation).

  • Exposure of the product to UV rays, either directly or indirectly, for more than 6 months (during storage), which may cause whitening and fragility of the material.

Storage Conditions:

  • The products covered by the warranty must be stored according to the manufacturer’s instructions, i.e., under shelter to protect from the weather (wind, rain, snow, hail), from the effects of moonlight and sunlight, and from all extreme pollution.

These storage conditions apply to anyone responsible for storing the products, regardless of their role in the project. Any failure to comply may result in the person being held responsible.

To the extent possible, the Beneficiary is encouraged to check the condition of the product before installation and notify the manufacturer of any reservations regarding the product.

The manufacturer reserves the right to refuse the warranty if they deem the Beneficiary has not adhered to the required storage conditions. The Beneficiary is responsible for proving that the products were stored according to the manufacturer’s storage guidelines.

Warranty Value:

  • 16 – 20 full years: 10% of the purchase value

Public Use Depreciation:

  • 0 – 2 full years: 100% of the purchase value

  • 3 – 10 full years: 50% of the purchase value

  • 11 – 15 full years: 10% of the purchase value

  • 16 – 20 full years: 5% of the purchase value

II. DECKING PIECES – CLADDING PIECES

The company BURGER ET CIE does not manufacture the cladding pieces (wood/composite boards, etc.) of its decking/cladding clip-fastening system; these products are guaranteed under the commercial warranty conditions set by their respective manufacturers.

UNDER NO CIRCUMSTANCES DOES BURGER ET CIE EXTEND TO ITS OWN CLIENTS OR TO ANY END USER OF THE CLADDING PRODUCTS SOLD THROUGH ITS INTERMEDIARY ANY COMMERCIAL WARRANTY COVERING THE CLADDING ELEMENTS OF ITS FASTENING SYSTEM (wood/composite boards, etc.).

In the event of any claim concerning the cladding pieces, BURGER ET CIE acts solely as an intermediary between the manufacturers of these products and the party affected by the issue concerning these pieces.

FOR INFORMATION PURPOSES ONLY, the URL hyperlinks to the commercial warranties of the main suppliers of cladding pieces to BURGER ET CIE are reproduced below, BUT under no circumstances is BURGER ET CIE bound by these warranties.

BURGER ET CIE cannot guarantee that the warranty conditions of the companies listed via the URL hyperlinks are up to date.

In the event of a conflict between the version displayed in the Warranty by BURGER ET CIE and those provided by its suppliers, the current version of the suppliers’ warranties shall prevail in all cases.
