Preamble
Applicable from November 1, 2024.
The GTC constitute the sole basis of the commercial relationship. They apply to all orders of GRAD® products placed with BURGER ET CIE SAS, ZI BOIS L’ABBESSE, 68660 LIEPVRE.
Any order implies full and entire acceptance of the GTC.

Legal Guarantee
It covers:
* any hidden defect meeting the conditions set by articles 1641 et seq. of the Civil Code, applicable for a period of 2 (two) years starting from the discovery of the defect, provided that legal action is taken within 5 (five) years following the sale.
A hidden defect is defined as any defect in the item sold that renders it unfit for the use for which it is intended, or that so diminishes its use that the buyer would not have purchased it or would have purchased it at a lower price if they had known about it.
*This guarantee is applicable provided that:
the defect was hidden,
the defect existed at the date of purchase,
the defect rendered the product unusable.
Art. 1641 C.civ. Duration: 2 years from discovery, within 5 years of sale.
Conditions: hidden defect, existing at purchase, rendering the product unusable.
It covers:
* any defect related to the conformity of the product, within the meaning of articles L. 217-4 et seq. of the Consumer Code, requiring any seller to guarantee the conformity of goods sold to consumers, for a period of 2 years from the delivery of the goods and exclusively benefits consumer clientele as defined by the introductory article of the Consumer Code.
The conditions for legal guarantees are governed by the provisions set by the legal and regulatory standards applicable to each of them.
Commercial Guarantee
Commercial in nature, the Manufacturer’s guarantee (hereinafter the “Guarantee”) is complementary and optional; it constitutes the sole contractual guarantee offered by BURGER ET CIE for its “GRAD” brand products.
The Guarantee is offered by the Manufacturer to the end-user of the products it manufactures under the GRAD brand (hereinafter the “Beneficiary”);
The Manufacturer reserves the right to occasionally modify the terms of this Guarantee, with modifications applying to affected products purchased after their entry into force;
The Beneficiary may take action directly with each professional involved in the design and installation of the products covered by the Guarantee by invoking their respective commercial guarantees, which the user may benefit from.
The Manufacturer is not bound by the commercial guarantees offered by other parties involved in the manufacturing, design, and installation process of the products delivered to the Beneficiary, and in particular by the professional installing the Manufacturer’s products (hereinafter the “Installer”).
The Manufacturer is only bound by its Guarantee.
The Guarantee covers defects found on the products listed below, in compliance with the general and specific conditions of the Guarantee.
The conditions for implementing the Guarantee (products concerned, duration, guarantor, conditions, exclusions, etc.) are mentioned in the “General Conditions” and “Specific Conditions” of guarantee for each product.
It constitutes a contractual commitment by the Manufacturer to the Beneficiary within the meaning of articles L.217-15 et seq. of the Consumer Code.
The Guarantee applies only to the Beneficiary if they can prove to the Manufacturer that the installation, care, and maintenance instructions issued by the Manufacturer for its products, whether general or specific to each product, have been followed.
To the extent possible, the Beneficiary must raise reservations upon acceptance of their work if they believe that the various parties involved in the installation of the ordered product (and in particular the Installer) have not complied with the storage, maintenance, etc., conditions set by the Manufacturer.
The Guarantee can only apply if the use of GRAD products corresponds to the intended purpose by BURGER ET CIE for these products, as shown on the technical data sheets of the products marketed by it.
In case of doubt, any Beneficiary is asked to ensure the suitability of the intended use of GRAD products with their own intended use.
BURGER ET CIE cannot be held responsible for any use of its products that does not correspond to the uses recommended by it. Otherwise, the Guarantee cannot apply. It is the responsibility of each Beneficiary to ensure this by consulting the product data sheets and product information available in the GRAD catalogs or on the website https://grad-system.com/.
In the event of the Guarantee being activated, the Manufacturer reserves the right to verify whether storage and maintenance conditions have been met by all persons who may have stored or maintained the products and to take any recourse against the person responsible for a breach of these obligations.
*The Guarantee does not apply to replacement and wear parts (natural wear and tear of the Product – wear caused by lack of maintenance or improper maintenance; wear caused by non-compliance with the Manufacturer’s maintenance guide which it provides),
*The Guarantee does not apply to products not listed in the specific conditions
*Removal and reinstallation costs are in no way covered by the Guarantee
Depending on the nature of the components of the “GRAD” brand products, the following incidents are expressly excluded from the Guarantee:
For wood-based products: warping, cracking, splitting, resin pockets
For aluminum-based products: surface whitening (slight surface oxidation not affecting the mechanical strength of the rails) of the “GRAD” brand product due to contact with metallic products (copper, galvanized steel) or following immersion, installation near the sea (seawater spray), or prolonged contact with strongly acidic or alkaline products;
For steel-based products:
*The Guarantee does not apply to replacement and wear parts (natural wear and tear of the Product – wear caused by lack of maintenance or improper maintenance; wear caused by non-compliance with the Manufacturer’s maintenance guide which it provides),
*The Guarantee does not apply to products not listed in the specific conditions
*Removal and reinstallation costs are in no way covered by the Guarantee
Depending on the nature of the components of the “GRAD” brand products, the following incidents are expressly excluded from the Guarantee:
For wood-based products: warping, cracking, splitting, resin pockets
For aluminum-based products: surface whitening (slight surface oxidation not affecting the mechanical strength of the rails) of the “GRAD” brand product due to contact with metallic products (copper, galvanized steel) or following immersion, installation near the sea (seawater spray), or prolonged contact with strongly acidic or alkaline products;
For steel-based products: slight traces of surface corrosion due to exposure of galvanization near the sea (seawater spray);
For stainless steel products: traces of corrosion due to lack of maintenance related to non-compliance with maintenance conditions set by the Seller;
For plastic products: permanent exposure of products to light for more than 6 months (during storage) which can cause whitening and fragility of the material).

The Guarantee applies for a period defined below, starting from the date indicated on the Acceptance Report of the work in case of express acceptance, or failing that, from the date of issue of the invoice from the GRAD products installer, for orders placed from January 1, 2026.
The Guarantee ends upon expiration of this period, the conditions of which may vary depending on the product manufactured by the Manufacturer and in particular on the nature of the use of the products covered by the Guarantee.
*Territorial scope of the Guarantee: All countries where our GRAD products are installed (including EU Member States – England – Switzerland, etc.).
Only the products listed below are covered by the Guarantee according to the specific conditions mentioned below.
STRUCTURE
BURGER ET CIE sells to its customers under the GRAD brand, a clip-on decking/cladding concept composed of a structure and cladding or decking elements.
For the structural components of its concept, BURGER ET CIE offers Beneficiaries the Guarantee applicable under the following specific conditions for each GRAD brand product listed below.
The specific conditions of the Guarantee for this product are defined according to the technical recommendations described and offered by Grad.
Guarantee Duration
20 years
This Guarantee is valid for a period of 20 years starting from the date indicated on the Acceptance Report of the work in case of express acceptance, or failing that, from the date of issue of the Installer’s invoice.
It does not apply to defects that appear or are notified to the Supplier by the Beneficiary after the expiry of the guaranteed period.

Damage covered by the Guarantee
* Oxidation presenting structural risks, showing deep corrosion causing perforations in the rails installed according to best practices.
Compliance with best practices by the client, the project manager, and the various parties involved (including the Installer) in the execution of the ordered project is a condition for the Guarantee to apply.
Exclusions
The Guarantee does not apply:
– in case of non-compliance with the conditions dictated by BURGER ET CIE, particularly those in the installation guides provided by BURGER ET CIE (according to the version applicable at the time the Guarantee is invoked),
– when the exclusions listed below have contributed to the damage:
- Contact with seawater (immersion of rails, rails installed near the sea),
- Contact with another metal with an inappropriate galvanic couple (copper, galvanized steel, etc.),
- Chemical treatment,
- Color and appearance change due to natural aging,
- Installation in an industrial area, due to the risk of chemical discharges accelerating corrosion,
- Surface whitening (slight surface oxidation not affecting the mechanical strength of the rails),
- Rails in prolonged contact with strongly acidic or alkaline products.
Storage conditions for “Aluminum Rail”
The products covered by the Guarantee must be stored according to the Manufacturer’s instructions, i.e., under shelter protecting them from bad weather (wind, rain, snow, hail), the effects of moonlight and sunlight, and any extreme pollution.
Storage conditions apply to all persons who may store the products covered by the Guarantee, regardless of their role in the project. Any failure by one of them may lead to their liability being invoked.
To the extent possible, the Beneficiary is invited to check the condition of the product before installation and to notify the Manufacturer of any reservations.
The Manufacturer reserves the right not to apply the Guarantee if it deems that the Beneficiary has not complied with the storage obligations incumbent upon them. The Beneficiary must then prove that they stored the products covered by the Guarantee according to the storage conditions set by the Manufacturer.
In the event of the Guarantee being activated, the Manufacturer reserves the right to verify whether storage conditions have been met by all persons who may have stored or maintained the products and to take any recourse against the person responsible for a breach of these obligations.

*Replacement of the initially delivered goods:
The Manufacturer provides the Beneficiary with a volume of goods equivalent/equal to the purchase value, reduced by the application of a depreciation rate varying according to the duration of use of the damaged goods *:
*for private use:
- 0 – 2 full years: 100% of the purchase value
- 3 – 10 full years: 75% of the purchase value
- 11 – 15 full years: 25% of the purchase value
- 16 – 20 full years: 10% of the purchase value.
* for public use:
The specific conditions of the Guarantee for this product are defined according to the technical recommendations described and offered by Grad.
Guarantee Duration
20 years
This Guarantee is valid for a period of 20 years starting from the date indicated on the Acceptance Report of the work in case of express acceptance, or failing that, from the date of issue of the Installer’s invoice.

* Abnormal deformation or breakage of the clip occurring after installation and use in accordance with recommended practices.
Compliance with best practices by the client, the project manager, and the various parties involved in the execution of the ordered project is a condition for the Guarantee to apply.
Conditions
The use of wood species, profiles, and structures must be validated by BURGER ET CIE for the Guarantee to apply
* Operating temperature range: between -20°C and +60°C.
Exclusions
The Guarantee does not apply:
- in case of non-compliance with the conditions dictated by BURGER ET CIE, particularly those in the installation guides provided by BURGER ET CIE (according to the version applicable at the time the Guarantee is invoked),
- in case of direct or indirect exposure to UV rays for more than 6 months (during product storage), which may cause whitening and fragility of the material composing the product.
Storage conditions
The products covered by the Guarantee must be stored according to the Manufacturer’s instructions, i.e., under shelter protecting them from bad weather (wind, rain, snow, hail), the effects of moonlight and sunlight, and any extreme pollution.
Storage conditions apply to all persons who may store the products covered by the Guarantee, regardless of their role in the project. Any failure by one of them may lead to their liability being invoked.
To the extent possible, the Beneficiary is invited to check the condition of the product before installation and to notify the Manufacturer of any reservations.

* Breakage of the pedestal occurring after installation and use in accordance with recommended practices.
Compliance with best practices by the client, the project manager, and the various parties involved in the execution of the ordered project is a condition for the Guarantee to apply.
Conditions
- Operating temperature range: between -20°C and +60°C,
- Stable base (no risk of sinking or deformation of the base),
- Use of Top+ (stiffener) from 4 riser heights.
Exclusions
The Guarantee does not apply:
- in case of non-compliance with the conditions dictated by BURGER ET CIE, particularly those in the installation and maintenance guides provided by BURGER ET CIE (according to the version applicable at the time the Guarantee is invoked),
- in case of direct or indirect exposure of the product to UV rays for more than 6 months (during storage), which may cause whitening and fragility of the material composing the product.

- Use within a temperature range: between -20°C and +60°C.
- Hard base (concrete or tiles).
- Private use only (solicitation 1 according to DTU 51.4).
Exclusions
The Guarantee does not apply:
- in case of non-compliance with the conditions dictated by BURGER ET CIE, particularly those in the installation and maintenance guides provided by BURGER ET CIE (according to the version applicable at the time the Guarantee is invoked),
- in case of direct or indirect exposure to UV rays for more than 6 months (during storage), which may cause whitening and fragility of the material composing the product,
- in case of installation and use of the product on a terrace with a waterproofing system.
Storage conditions
The products covered by the Guarantee must be stored according to the Manufacturer’s instructions, i.e., under shelter protecting them from bad weather (wind, rain, snow, hail), the effects of moonlight and sunlight, and any extreme pollution.
Storage conditions apply to all persons who may store the products covered by the Guarantee, regardless of their role in the project. Any failure by one of them may lead to their liability being invoked.
To the extent possible, the Beneficiary is invited to check the condition of the product before installation and to notify the Manufacturer of any reservations.
The Manufacturer reserves the right not to apply the Guarantee if it deems that the Beneficiary has not complied with the storage obligations incumbent upon them. The Beneficiary must then prove that they stored the products covered by the Guarantee according to the storage conditions set by the Manufacturer.

- Assembled on a “Grad” brand aluminum profile.
- Hard base (concrete or tiles) or stable base.
Exclusions
The Guarantee does not apply:
- In case of non-compliance with the conditions dictated by BURGER ET CIE, particularly those in the installation and maintenance guides provided by BURGER ET CIE (applicable at the time the Guarantee is invoked),
- In case of direct or indirect exposure of the product to UV rays for more than 6 months (during storage), which may cause whitening and fragility of the material composing the product.
