Commercial Guarantees

Preamble

Applicable from January 1, 2026.
The GTC constitute the sole basis of the commercial relationship. They apply to all orders of GRAD® products placed with BURGER ET CIE SAS, ZI BOIS L’ABBESSE, 68660 LIEPVRE.
Any order implies full and entire acceptance of the GTC.

Legal Guarantee

It covers:

* any hidden defect meeting the conditions set by articles 1641 et seq. of the Civil Code, applicable for a period of 2 (two) years starting from the discovery of the defect, provided that legal action is taken within 5 (five) years following the sale.

A hidden defect is defined as any defect in the item sold that renders it unfit for the use for which it is intended, or that so diminishes its use that the buyer would not have purchased it or would have purchased it at a lower price if they had known about it.

*This guarantee is applicable provided that:

the defect was hidden,
the defect existed at the date of purchase,
the defect rendered the product unusable.

Hidden Defect Guarantee + −

Art. 1641 C.civ. Duration: 2 years from discovery, within 5 years of sale.
Conditions: hidden defect, existing at purchase, rendering the product unusable.

Legal Guarantee of Conformity + −

It covers:

* any defect related to the conformity of the product, within the meaning of articles L. 217-4 et seq. of the Consumer Code, requiring any seller to guarantee the conformity of goods sold to consumers, for a period of 2 years from the delivery of the goods and exclusively benefits consumer clientele as defined by the introductory article of the Consumer Code.

The conditions for legal guarantees are governed by the provisions set by the legal and regulatory standards applicable to each of them.

Commercial Guarantee

Commercial in nature, the Manufacturer’s guarantee (hereinafter the “Guarantee”) is complementary and optional; it constitutes the sole contractual guarantee offered by BURGER ET CIE for its “GRAD” brand products.

The Guarantee is offered by the Manufacturer to the end-user of the products it manufactures under the GRAD brand (hereinafter the “Beneficiary”);
The Manufacturer reserves the right to occasionally modify the terms of this Guarantee, with modifications applying to affected products purchased after their entry into force;
The Beneficiary may take action directly with each professional involved in the design and installation of the products covered by the Guarantee by invoking their respective commercial guarantees, which the user may benefit from.
The Manufacturer is not bound by the commercial guarantees offered by other parties involved in the manufacturing, design, and installation process of the products delivered to the Beneficiary, and in particular by the professional installing the Manufacturer’s products (hereinafter the “Installer”).
The Manufacturer is only bound by its Guarantee.

Scope of Application + −

The Guarantee covers defects found on the products listed below, in compliance with the general and specific conditions of the Guarantee.

The conditions for implementing the Guarantee (products concerned, duration, guarantor, conditions, exclusions, etc.) are mentioned in the “General Conditions” and “Specific Conditions” of guarantee for each product.

It constitutes a contractual commitment by the Manufacturer to the Beneficiary within the meaning of articles L.217-15 et seq. of the Consumer Code.

General Conditions + −

The Guarantee applies only to the Beneficiary if they can prove to the Manufacturer that the installation, care, and maintenance instructions issued by the Manufacturer for its products, whether general or specific to each product, have been followed.

To the extent possible, the Beneficiary must raise reservations upon acceptance of their work if they believe that the various parties involved in the installation of the ordered product (and in particular the Installer) have not complied with the storage, maintenance, etc., conditions set by the Manufacturer.

The Guarantee can only apply if the use of GRAD products corresponds to the intended purpose by BURGER ET CIE for these products, as shown on the technical data sheets of the products marketed by it.

In case of doubt, any Beneficiary is asked to ensure the suitability of the intended use of GRAD products with their own intended use.

BURGER ET CIE cannot be held responsible for any use of its products that does not correspond to the uses recommended by it. Otherwise, the Guarantee cannot apply. It is the responsibility of each Beneficiary to ensure this by consulting the product data sheets and product information available in the GRAD catalogs or on the website https://grad-system.com/.

In the event of the Guarantee being activated, the Manufacturer reserves the right to verify whether storage and maintenance conditions have been met by all persons who may have stored or maintained the products and to take any recourse against the person responsible for a breach of these obligations.

General Exclusions + −

*The Guarantee does not apply to replacement and wear parts (natural wear and tear of the Product – wear caused by lack of maintenance or improper maintenance; wear caused by non-compliance with the Manufacturer’s maintenance guide which it provides),

*The Guarantee does not apply to products not listed in the specific conditions

*Removal and reinstallation costs are in no way covered by the Guarantee

Depending on the nature of the components of the “GRAD” brand products, the following incidents are expressly excluded from the Guarantee:

Depending on the nature of the components of the “GRAD” brand products, the following incidents are expressly excluded from the Guarantee:

For wood-based products: warping, cracking, splitting, resin pockets
For aluminum-based products: surface whitening (slight surface oxidation not affecting the mechanical strength of the rails) of the “GRAD” brand product due to contact with metallic products (copper, galvanized steel) or following immersion, installation near the sea (seawater spray), or prolonged contact with strongly acidic or alkaline products;
For steel-based products: slight traces of surface corrosion due to exposure of galvanization near the sea (seawater spray);
For stainless steel products: traces of corrosion due to lack of maintenance related to non-compliance with maintenance conditions set by the Seller;
For plastic products: permanent exposure of products to light for more than 6 months (during storage) which can cause whitening and fragility of the material).

Duration + −

The Guarantee applies for a period defined below, starting from the date indicated on the Acceptance Report of the work in case of express acceptance, or failing that, from the date of issue of the invoice from the GRAD products installer, for orders placed from January 1, 2026.

The Guarantee ends upon expiration of this period, the conditions of which may vary depending on the product manufactured by the Manufacturer and in particular on the nature of the use of the products covered by the Guarantee.

*Territorial scope of the Guarantee: All countries where our GRAD products are installed (including EU Member States – England – Switzerland, etc.).

Only the products listed below are covered by the Guarantee according to the specific conditions mentioned below.

STRUCTURE

BURGER ET CIE sells to its customers under the GRAD brand, a clip-on decking/cladding concept composed of a structure and cladding or decking elements.

For the structural components of its concept, BURGER ET CIE offers Beneficiaries the Guarantee applicable under the following specific conditions for each GRAD brand product listed below.

ALUMINUM RAIL + −

The specific conditions of the Guarantee for this product are defined according to the technical recommendations described and offered by Grad.

Guarantee Duration
20 years

This Guarantee is valid for a period of 20 years starting from the date indicated on the Acceptance Report of the work in case of express acceptance, or failing that, from the date of issue of the Installer’s invoice.

It does not apply to defects that appear or are notified to the Supplier by the Beneficiary after the expiry of the guaranteed period.

Damage covered by the Guarantee
* Oxidation presenting structural risks, showing deep corrosion causing perforations in the rails installed according to best practices.

Compliance with best practices by the client, the project manager, and the various parties involved (including the Installer) in the execution of the ordered project is a condition for the Guarantee to apply.

Exclusions
The Guarantee does not apply:

– in case of non-compliance with the conditions dictated by BURGER ET CIE, particularly those in the installation guides provided by BURGER ET CIE (according to the version applicable at the time the Guarantee is invoked),
– when the exclusions listed below have contributed to the damage:

Immersion, even partial or temporary, in chlorinated, fresh or salt water, as well as any installation by the sea where the rails are likely to be exposed to splashes, sea spray or runoff of salt water,
Contact with another metal with an inappropriate galvanic couple (copper, galvanized steel, etc.),
Chemical treatment,
Color and appearance change due to natural aging,
Installation in an industrial area, due to the risk of chemical discharges accelerating corrosion,
Surface whitening (slight surface oxidation not affecting the mechanical strength of the rails),
Rails in prolonged contact with strongly acidic or alkaline products.

Storage conditions for “Aluminum Rail”
The products covered by the Guarantee must be stored according to the Manufacturer’s instructions, i.e., under shelter protecting them from bad weather (wind, rain, snow, hail), the effects of moonlight and sunlight, and any extreme pollution.

Storage conditions apply to all persons who may store the products covered by the Guarantee, regardless of their role in the project. Any failure by one of them may lead to their liability being invoked.

To the extent possible, the Beneficiary is invited to check the condition of the product before installation and to notify the Manufacturer of any reservations.

The Manufacturer reserves the right not to apply the Guarantee if it deems that the Beneficiary has not complied with the storage obligations incumbent upon them. The Beneficiary must then prove that they stored the products covered by the Guarantee according to the storage conditions set by the Manufacturer.

In the event of the Guarantee being activated, the Manufacturer reserves the right to verify whether storage conditions have been met by all persons who may have stored or maintained the products and to take any recourse against the person responsible for a breach of these obligations.

Guarantee Value:
*Replacement of the initially delivered goods:
The Manufacturer provides the Beneficiary with a volume of goods equivalent/equal to the purchase value, reduced by the application of a depreciation rate varying according to the duration of use of the damaged goods *:

*for private use:

0 – 2 full years: 100% of the purchase value
3 – 10 full years: 75% of the purchase value
11 – 15 full years: 25% of the purchase value
16 – 20 full years: 10% of the purchase value.

* for public use:

0 – 2 full years: 100% of the purchase value,

3 – 10 full years: 50% of the purchase value,

11 – 15 full years: 10% of the purchase value,

16 – 20 full years: 5% of the purchase value.

ANODIZED ALUMINUM RAIL + −

The specific conditions of the Warranty for anodized aluminum rails are defined in accordance with the technical recommendations described and provided by Grad.

Warranty period
2 years

This Warranty is valid for a period of 2 years starting from the date stated in the acceptance report of the works in the case of express acceptance, failing which from the date of issue of the Installer’s invoice.

It does not apply to defects that appear, or that are notified to the Supplier by the Beneficiary, after the warranty period has expired.

Claim covered by the Warranty
Oxidation presenting structural risks, revealing deep corrosion that causes perforations in anodized aluminum rails installed in accordance with the practices recommended by industry standards.

Compliance with industry standards by the project owner, the project manager and the various parties involved, including the Installer, in carrying out the ordered works is a condition for the Warranty to apply.

Exclusions
The Warranty does not apply:

– where the conditions laid down by BURGER ET CIE have not been complied with, in particular those set out in the installation guides issued by BURGER ET CIE, in the version applicable when the product is installed,
– where the exclusion cases listed below have contributed to the claim:

Immersion, even partial or temporary, in chlorinated, fresh or salt water,
Contact with another metal whose galvanic couple is unsuitable, in particular copper or galvanized steel,
Chemical treatment,
Change in color or appearance due to natural ageing,
Installation in an industrial area presenting a risk of chemical emissions likely to accelerate corrosion,
Whitening or slight surface oxidation that does not affect the mechanical strength of the rails,
Prolonged contact with strongly acidic or alkaline products,
Alteration of the anodizing treatment resulting from impacts, scratches, machining, cutting or other damage occurring after treatment.

Storage conditions for “Anodized aluminum rail”
The products covered by the Warranty must be stored in accordance with the conditions set by the Manufacturer, namely under shelter that protects them from bad weather, in particular wind, rain, snow and hail, as well as from pollution or substances likely to damage the anodized surface.

The storage conditions apply to all persons likely to store the products covered by the Warranty, regardless of their role in carrying out the works. Any failure by any of them may give rise to their liability.

Where possible, the Beneficiary is invited to check the condition of the product before installation and to notify the Manufacturer of any reservation.

The Manufacturer reserves the right not to apply the Warranty if it considers that the Beneficiary has not complied with the storage obligations incumbent on them, and the Beneficiary must prove that the products covered by the Warranty were stored in accordance with the storage conditions set by the Manufacturer.

If the Warranty is invoked, the Manufacturer reserves the right to verify whether the storage conditions have been complied with by all persons likely to store or maintain the products, and to take any action against the person responsible for a breach of these obligations.

Warranty value:
Replacement of the goods originally delivered:
The Manufacturer provides the Beneficiary with a volume of goods equivalent to the purchase value of the goods recognized as defective, under the following conditions:

0 – 2 full years: 100% of the purchase value.

CLIPS + −

The specific conditions of the Guarantee for this product are defined according to the technical recommendations described and offered by Grad.

Guarantee Duration
20 years

It does not apply to defects that appear or are notified to the Supplier by the Beneficiary after the expiry of the guaranteed period.

Damage covered by the Guarantee
* Abnormal deformation or breakage of the clip occurring after installation and use in accordance with recommended practices.

Compliance with best practices by the client, the project manager, and the various parties involved in the execution of the ordered project is a condition for the Guarantee to apply.

Conditions
The use of wood species, profiles, and structures must be validated by BURGER ET CIE for the Guarantee to apply
* Operating temperature range: between -20°C and +60°C.

Exclusions
The Guarantee does not apply:

in case of non-compliance with the conditions dictated by BURGER ET CIE, particularly those in the installation guides provided by BURGER ET CIE (according to the version applicable at the time the Guarantee is invoked),
in case of direct or indirect exposure to UV rays for more than 6 months (during product storage), which may cause whitening and fragility of the material composing the product.

Storage conditions
The products covered by the Guarantee must be stored according to the Manufacturer’s instructions, i.e., under shelter protecting them from bad weather (wind, rain, snow, hail), the effects of moonlight and sunlight, and any extreme pollution.

To the extent possible, the Beneficiary is invited to check the condition of the product before installation and to notify the Manufacturer of any reservations.

* The duration of use begins from the express acceptance without reservation of the ordered work (i.e., the date mentioned in the acceptance report), or failing that, from the date of issue of the Installer’s invoice.

The specific conditions of the Guarantee for this product are defined according to the technical recommendations described and offered by Grad.

Operating temperature range: between -20°C and +60°C,
Stable base (no risk of sinking or deformation of the base),
Use of Top+ (stiffener) from 4 riser heights.

Exclusions
The Guarantee does not apply:

in case of non-compliance with the conditions dictated by BURGER ET CIE, particularly those in the installation and maintenance guides provided by BURGER ET CIE (according to the version applicable at the time the Guarantee is invoked),
in case of direct or indirect exposure of the product to UV rays for more than 6 months (during storage), which may cause whitening and fragility of the material composing the product.

To the extent possible, the Beneficiary is invited to check the condition of the product before installation and to notify the Manufacturer of any reservations.

Use within a temperature range: between -20°C and +60°C.
Hard base (concrete or tiles).
Private use only (solicitation 1 according to DTU 51.4).

Exclusions
The Guarantee does not apply:

in case of non-compliance with the conditions dictated by BURGER ET CIE, particularly those in the installation and maintenance guides provided by BURGER ET CIE (according to the version applicable at the time the Guarantee is invoked),
in case of direct or indirect exposure to UV rays for more than 6 months (during storage), which may cause whitening and fragility of the material composing the product,
in case of installation and use of the product on a terrace with a waterproofing system.

To the extent possible, the Beneficiary is invited to check the condition of the product before installation and to notify the Manufacturer of any reservations.

In case of direct or indirect exposure of the product to UV rays for more than 6 months (during storage), which may cause whitening and fragility of the material composing the product.

To the extent possible, the Beneficiary is invited to check the condition of the product before installation and to notify the Manufacturer of any reservations.

SILVADEC® + −

The specific conditions of the Warranty for Silvadec wood-composite decking boards are defined in accordance with the technical recommendations described and provided by BURGER ET CIE and SILVADEC SAS.

Warranty period
15 years – Structural warranty for residential use

BURGER ET CIE warrants Silvadec wood-composite decking boards for a period of fifteen (15) years from the date of purchase, for residential use, subject to normal use and regular maintenance.

During this period, the boards are warranted against:

the formation of splinters;
structural damage resulting from fungal attack;
structural damage resulting from attack by wood-boring insects;
structural damage resulting from termite attack.

10 years – Color warranty for co-extruded boards

For co-extruded wood-composite products in the Atmosphère and Nuances ranges, BURGER ET CIE also warrants color retention for a period of ten (10) years from the date of purchase, under normal conditions of use and maintenance.

Color retention is defined by a value corresponding to a grey scale rating ≥ 4 according to standard ISO 105-A02.

The Warranty does not apply to defects that appear, or that are notified to the Supplier by the Beneficiary, after the applicable Warranty period has expired.

Claims covered by the Warranty
Subject to compliance with the conditions of use, installation and maintenance set by BURGER ET CIE and SILVADEC SAS, the Warranty covers:

the formation of splinters on Silvadec decking boards;
structural damage caused by fungi, wood-boring insects or termites;
for the co-extruded Atmosphère and Nuances ranges, a color change that no longer meets the guaranteed performance level, i.e. a grey scale rating ≥ 4 according to standard ISO 105-A02.

Compliance with industry standards by the project owner, the project manager and the various parties involved, including the Installer in particular, as well as with the installation and maintenance recommendations of BURGER ET CIE and SILVADEC SAS, is a condition for the Warranty to apply.

Exclusions
The Warranty does not apply where the damage is attributable, wholly or in part, to:

improper installation of Silvadec boards, Grad® deck profiles or accessories, and/or failure to comply with the installation principles and maintenance sheets provided by BURGER ET CIE and SILVADEC SAS, in particular the Silvadec Installation Guide and sheet FE03 – Maintenance advice for Atmosphère decking boards;
failure to comply with the rules set by the applicable DTU and Eurocodes, the recommendations of professional bodies, in particular the FCBA guides, or specific local building rules;
use of Silvadec wood-composite decking boards or profiles beyond normal use or for an application other than that intended by SILVADEC SAS in its commercial and technical documentation;
use of fixing clips other than Grad® fixing clips;
movement, deformation, collapse or settlement of the ground or of the supporting structure on which the Silvadec wood-composite decking boards are installed;
any case of force majeure, in particular flood, storm, earthquake, lightning, vandalism or any other exceptional external event;
an environmental problem or the presence of external substances, in particular atmospheric pollution, surface mold, dirt, fruit, rust, grease or other agents likely to stain or damage the products;
the absence or inadequacy of regular maintenance in line with the recommendations of BURGER ET CIE and SILVADEC SAS;
normal variations in appearance, in particular differences in color, texture or brushing from one board to another;
natural changes in color resulting from exposure to UV radiation, insofar as they remain within the limits provided for by this Warranty for products covered by a color retention warranty;
inappropriate handling, inadequate storage, negligence or improper treatment attributable to the buyer or a third party;
any type of installation preventing sufficient ventilation beneath the structure;
direct or indirect contact with an unnatural heat source, in particular a barbecue, a cigarette, a pyrotechnic product or a fire.

Storage conditions for Silvadec boards
The products covered by the Warranty must be stored in accordance with the conditions set by BURGER ET CIE and SILVADEC SAS and in such a way as to avoid any deformation, deterioration, soiling or alteration before installation.

The storage conditions apply to all persons likely to store or handle the products, regardless of their role in carrying out the works.

Where possible, the Beneficiary is invited to check the condition of the products before installation and to notify the Manufacturer of any reservation.

The Manufacturer reserves the right not to apply the Warranty where damage results from inadequate handling, storage or treatment of the products by the Beneficiary or by a third party.

Implementation of the Warranty
In the event of a defect that may fall under this Warranty, the Beneficiary must inform BURGER ET CIE in writing and provide all the information needed to analyze the claim, in particular:

a precise description of the defect observed;
photographs showing the defect;
photographs and/or information identifying the installation system, the supporting structure and, where applicable, the groundwork;
a description of the environment in which the structure is located, in particular its possible proximity to an industrial, agricultural or wooded area or any other particular exposure;
proof of direct purchase of the boards concerned from BURGER ET CIE.

Coverage under the Warranty will only become effective after the claim has been analyzed and validated by BURGER ET CIE.

Warranty value
If the claim is accepted, BURGER ET CIE will, at its sole discretion:

replace the Silvadec products recognized as defective or showing a proven non-conformity with identical or similar Silvadec products, which may differ slightly in shade or appearance from the products originally installed;

refund a portion of the purchase price paid by the Beneficiary for the products recognized as defective.

The amount of this coverage may take into account the date of purchase, the period of use and the wear and tear of the products concerned. A reduction in their value may thus be applied to reflect the time elapsed and their use.

BURGER ET CIE reserves the right to modify or suspend at any time the availability of certain Silvadec models, ranges, boards, profiles or accessories. Replacement may therefore be made with a product having similar characteristics or shade to the product originally delivered.

Shipping, delivery, removal, disposal or reinstallation costs incurred by the removal or replacement of defective Silvadec products are not covered by this Warranty.

The liability of BURGER ET CIE under this Warranty is limited to the replacement of the products recognized as defective or to the refund provided for above. In particular, it may not give rise to compensation for special, incidental or indirect damages.

No person or entity is authorized to make, on behalf of BURGER ET CIE or SILVADEC SAS, any commitments or statements regarding the characteristics, performance or installation recommendations of Silvadec products that differ from those set out in this Warranty and in the applicable technical documentation and installation principles.

Territories covered by the Warranty
This Warranty applies only in the following territories:

European Union countries, Iceland, Norway, Switzerland, Bosnia and Herzegovina, Serbia, Kosovo, Montenegro, North Macedonia, Albania, Moldova, Great Britain and Morocco.
